For limited liability company “DGIM STUDIO” (hereinafter – “DGIM STUDIO”) ensuring of rights’ and interests’ protection of the users is one of the most priority issues considering the peculiarities of the personal data processing provided by users when purchasing the licenses on usage of digital goods (pictures, images, graphic elements, etc.) and DGIM STUDIO’s services accomplished via the website: https://dgimstudio.com/ (hereinafter – the “Website”).
Provision of personal data and personal identifying information (commonly known as PII) is necessary for the user in order to use the Website and its services and access to DGIM STUDIO’s licenses on digital goods usage and services purchase. Non-provision of the respective PII by the user shall result in inability for DGIM STUDIO to provide digital goods and services to the user.
Within the present Policy under PII the information relating to an identified or identifiable user is understood, in particular: name, surname, e-mail address, address and country of residence, IP-address, etc.
PII do not include anonymous data that do not relate to an identified or are not identifiable in relation to concrete user as well as depersonalized data.
Purpose of user’s PII processing: provision of the user’s access to DGIM STUDIO’s licenses on digital goods usage and services purchase via the Website and its services.
DGIM STUDIO shall conduct processing of the following user’s PII:
- personal data: name, surname, e-mail address, address and country of residence, - requested for user’s account creation on the Website;
- authorization data (e-mail address and password);
- information about user’s activity on the Website (ID of the received digital good/service, date of receipt, time of receipt, amount of received goods/services, amount of the order, ID of the order (payment));
- statistics data related to the user’s account on the Website (amount of the digital goods/services received);
- information about computer, device or browser within the access to the Website that is processed by automated means, i.e. information about computer or mobile device, including IP-address, country of the entrance to the user’s account, operational system, type of the browser and cookies;
- agreement of the user to receive DGIM Studio’s newsletters and promotional materials.
DGIM STUDIO does not process the financial information about the transactions conducted by the user in connection with the purchases made (including the information about the banking card number, name of the cardholder, card’s validity term, etc.), such information is requested and processed by the payment’s processor and (or) the servicing bank.
The user hereby freely gives, specific, informed and unambiguous consent to the processing of the PII relating to him or her and mentioned above for the purposes of PII processing indicated hereto.
The user has the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Withdrawal is made by the mere notification of the DGIM STUDIO via its support service, i.e. by sending an e-mail to the address privacy@dgimstudio.com with the topic “Consent withdrawal”.
The user is also entitled to:
- request the access to and rectification or erasure of PII processed by DGIM STUDIO;
- restrict the processing of PII concerning the user;
- object to processing of PII concerning the user;
- demand for realization of the right to data portability from DGIM STUDIO;
- exercise the right to lodge a complaint with a relevant supervisory authority.
The user is empowered to request 1 (one) copy of the PII undergoing processing free of charge. Any additional copies are provided on a reimbursement basis.
DGIM STUDIO hereby undertakes not to conduct any disclosure or transfer of the user’s PII to any third parties without receipt of personal consent of the user, except for transfer conducted to the payment’s processor (“EComCharge” LLC, whose registered address is 220116, 104 Dzerzhinskogo ave., office 7, Minsk, Belarus) to the extent reasonable for financial operations conducting.
DGIM STUDIO uses the safety measures for ensuring the confidentiality of the user’s PII as well as for protection of the user’s PII from loss, theft, unauthorized access, misuse, amendment or destruction, in particular, the access to user’s PII is provided only to the duly authorized employees of DGIM Studio when necessary whereas the PII is usually processed automatically. DGIM Studio has also implemented the reasonable technical data protection measures that are corresponding to the current level of technical development.
The user is obliged to ensure safety of the authorization data indicated by him or her for safe usage of the Website.
DGIM STUDIO stores the PII relating to the user within the whole term of the Website usage and for subsequent 2 (two) years after the last purchase with the usage of the user’s account and (or) its termination (deletion) by the user. Upon termination of the mentioned term the PII relating to the user are subject to destruction or depersonalization to ensure anonymity of such information via deletion of the personal identifying information.
In case of the user’s agreement to receive DGIM Studio’s newsletters and promotional materials, the user will receive the respective materials on the e-mail address indicated within the registration on the Website. The user may at any time unsubscribe from such receipt.
Conditions of the present Policy may be unilaterally changed by DGIM STUDIO if required under the applicable laws or in other relevant cases with obligatory notification of the users. New version of the Policy enters into legal force and is subject to observance by the user after the user has expressly agreed to its applicability.
If the user does not agree to the applicability of the new version of the Policy, the user will discontinue the usage of the Website and will be not allowed to use its user’s account without provision of an unambiguous consent to the applicability of the new version of the Policy.
